Template — not yet legal advice. This document is a starting template only. It must be reviewed and approved by a qualified Kenyan advocate before it is published or relied on. Nothing on this page is legal advice, and it does not create an advocate-client relationship.
This Privacy Policy explains how Nyati Movers (“we”, “us”, “our”) handles personal data when you ask us for a quote, book a move, contact us, or use this website at nyatimovers.com.
We are based in Ruiru, Kiambu County, Kenya. We handle personal data in line with the Data Protection Act, 2019 and the regulations made under it, and we are answerable to the Office of the Data Protection Commissioner (ODPC).
Who we are
Nyati Movers is the data controller for the personal data described in this policy. If you have any question about this policy, or about how we handle your data, write to us at [email protected] or call +254 748 880 468.
What personal data we collect
We only ask for what we need to quote and carry out a move. That is normally:
- Who you are — your name.
- How to reach you — your phone number and email address.
- Where the move is — the collection address and the delivery address, including the floor, the estate and access details such as whether there is a lift or stairs.
- Details of the move — the property size, the date you want, the services you need, an inventory or description of what is being moved, and any items that are fragile, valuable or unusually heavy.
- Anything else you tell us — the content of your messages, emails, WhatsApp chats and calls with us, including photos or videos you send of the rooms.
- Website data — basic technical information collected automatically when you visit this site, as described under Cookies and analytics below.
We do not ask for sensitive personal data, and you should not send it to us. Please do not send us copies of ID documents, bank details or anything similar unless we have specifically explained why we need it.
Why we use it, and our lawful basis
| What we do with it | Lawful basis under the Data Protection Act, 2019 |
|---|---|
| Prepare and send you a quote; survey the property; answer your questions. | Steps taken at your request before entering into a contract. |
| Plan and carry out the move; brief the crew; contact you on the day. | Performance of our contract with you. |
| Invoice you and keep our accounting records. | Compliance with a legal obligation, and our legitimate business interests. |
| Handle a complaint, a damage claim or a dispute. | Our legitimate interests in defending and resolving claims; compliance with legal obligations. |
| Improve the website and understand how it is used. | Your consent, where consent is required for the cookies concerned. |
| Send you marketing messages about our services. | Your consent. You can withdraw it at any time. |
Who we share it with
We keep this deliberately narrow.
- Our crew. The team assigned to your move sees what they need to do the job — your name, your phone number, the two addresses, the access details and the inventory. Nothing more.
- Service providers who run our systems — for example our website host, our email provider and our accounting software. They process data on our instructions and are not permitted to use it for their own purposes.
- Authorities, where we are required to disclose data by law or by a court order.
We do not sell your personal data. We do not share it with anyone else for their own marketing, and we will not pass it to a third party for any other purpose without your consent.
Some of the services we use may store data on servers outside Kenya. Where that happens, we take reasonable steps to satisfy ourselves that the transfer meets the requirements of the Data Protection Act, 2019 and that the data is properly protected.
Cookies and analytics
This website uses cookies. Some are strictly necessary — they make the site work, keep it secure and remember your cookie choices. Others help us understand how visitors use the site, for example which pages they read and which links they follow, so we can improve it.
Analytics and any marketing cookies are only set where you have consented to them. You can change or withdraw that consent at any time, and you can block or delete cookies in your browser settings. Blocking strictly necessary cookies may stop parts of the site from working properly.
How long we keep it
We keep your personal data only as long as we have a reason to.
- Quotes that do not turn into a booking — kept for a short period in case you come back to us, then deleted.
- Completed moves — the move file and the related invoice are kept for as long as we are required to keep financial and tax records under Kenyan law, and for as long as a claim could still be brought.
- Marketing consents — kept until you withdraw them.
When we no longer need your data, we delete it or anonymise it.
How we protect it
We take reasonable technical and organisational measures to keep personal data safe, including access controls on our systems, limiting who in the team can see what, and giving the crew only the details they need for the job in front of them. No system is perfectly secure, but if a breach happens that is likely to affect your rights, we will act on it and notify the Office of the Data Protection Commissioner and, where required, you.
Your rights
Under the Data Protection Act, 2019 you have the right to:
- Be informed about how your data is used — that is what this policy is for.
- Access the personal data we hold about you.
- Correct data that is inaccurate, out of date or incomplete.
- Request deletion of your data where we no longer have a lawful reason to hold it.
- Object to how we are processing your data, including objecting to direct marketing at any time.
- Withdraw consent where our processing is based on consent. Withdrawing it does not affect anything we did lawfully before you withdrew it.
To exercise any of these rights, email [email protected]. We will respond within the period allowed by the Act. We may ask you to confirm your identity first, so that we do not hand your data to somebody else.
If you are not satisfied with how we have handled your data or your request, you may lodge a complaint with the Office of the Data Protection Commissioner in Kenya.
Children
Our services are aimed at adults. We do not knowingly collect personal data from children. If you believe a child has given us personal data, contact us and we will delete it.
Changes to this policy
We may update this policy from time to time. When we do, we will change the “last updated” date at the top of the page. If the change is significant, we will make that clear.
